Rape laws in India and all over the world

I attained the mature sense of the term sex when our biology teacher defined it under heading reproduction. My first encounter with the term was generally confined to giggling and laughing at the diagrams. It was a tender age to understand the gravity of the term. The course of time brought another term to light that was hiding behind the evil faces. It was RAPE. I didn't have the audacity to giggle to it. 

 

Flipping to the newspaper on 16th December 2013 my hands froze at the headline stating, "Chalti bus mei hua RAPE". With trembling hands and a soaked up throat, I read further.  The shackles of the incident brought goosebumps to my skin. I never experienced such goosebumps in my life. I switch on the television to see journalists yelling the headlines repeatedly. The victim was being carried to the hospital and the paparazzi quoting each detail out loud.  The newspapers shut close on 27th December when the victim took her last breath.

The feeble yarn of law that runs around our country is pillared by corruption and diplomacy. These worms are eating through the foundation. If the foundation is worn out how do you think the building will survive? The Supreme Court increased the punishment of gang rape from 20years to life imprisonment.

 

Rape as KURT COBAIN defines it " is one of the most terrible crimes on earth and it happens every few minutes. The problem with groups who deal with rape is that they try to educate women about how to defend themselves. What really needs to be done is teaching men not to rape. Go to the source and start there". Section 375 under IPC declared the act of sex by a man with a woman if it was done against her will or without her consent punishable. The Hindu once quoted, "The definition of rape also included sex when her consent has been obtained by putting her or any person in whom she is interested, in fear of death or of hurt".Thought our country has lined the pages of the constitution with numerous laws of sexual exploitation yet the elevation of the cases remains the same. The section 376 declared a punishment of seven years of jail extending to life imprisonment to whosoever commits the crime of rape.

Section 375 of the IPC, the Law Commission in its 172nd report came with the opinion of widening the scope of rape law to make it gender-neutral. According to a report a woman is assaulted every 26 minute. The journalist yells about the rape victims on the top of their voice but they never talk about the aftermaths of the subject.

 

The Supreme Court recommends several punishments seeing the intensity of the crime but justice is never served. Where India has lifetime imprisonment or death or the culprit,  the other countries like France and Israel sentences 15-16 years in prison. Rapists in Iran are subjected to stoning and also hanged till death. Saudi Arabia beheads the rapist, one of the brutal punishments in the history of law. North Korea's dictatorship is even more highlighted when the rapists are sentenced to death by firing troops. Afghanistan shoots the culprit in the head within four days of the rape. Norway provides the strictest punishment for any sexual harassment of 4-16 years of imprisonment.

 

No punishment is justifiable for this crime.  Rape is a crime of mind, a crime of body, and a crime of psychology. A lifetime punishment can never parallelize the pain of the victim.  Death would be an easy escape, it can never surpass the screams of horror, the pain of breaking the confidence, and the divinity of self. A few seconds of lust and anger can destroy the functioning of a soul.  And no punishment in the universe can ever drown the heinous of this crime.
